1. Data controller

Inteligart S.A. de C.V. (“Inteligart”), located at C. Tlacoquemecatl 123, Tlacoquemecatl del Valle, Benito Juárez, 03200 Ciudad de México, CDMX, Mexico, is responsible for processing your personal data under Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties and other applicable regulations.

2. Data we collect

We may process the following categories of personal data:

  • Identification and contact data: name, company, job title, email address and phone number when you contact us, submit a form or engage our services.
  • Tax and billing information: company name, tax identification information, tax address and other information required for invoicing, when applicable.
  • Browsing data: IP address, browser type, pages visited and cookies or similar technologies (see section 8).
  • Client data: information from advertising accounts our clients authorize us to manage (see section 3).
  • Information required for data-rights requests: contact information and documents required to verify the identity of the data subject or their representative.

We do not intentionally request sensitive personal data through this website or as part of the ordinary provision of our digital marketing services.

3. Use of data obtained from Google APIs

With our clients’ explicit authorization, Inteligart connects to the Google Ads API through Google OAuth and accesses only the advertising accounts authorized by the client.

When doing so:

  • What we access: configuration and performance data relating to campaigns, ad groups, ads, keywords, budgets and conversions in the Google Ads accounts assigned to us by the client.
  • How we use it: solely to provide services requested by the client, including producing reports, analyzing performance, and planning and carrying out campaign optimizations on behalf of the client who authorized access.
  • How we store it: data is primarily retrieved on demand and is not stored permanently, except for reports or information required to provide the contracted services or comply with applicable legal obligations. Access credentials or tokens are protected and access is limited to authorized personnel who require them to provide the service.
  • Access by Inteligart personnel: only authorized personnel may access the information when necessary to provide the service requested and authorized by the client.
  • Service providers and technology tools: we do not sell or rent data obtained from Google and do not use it for Inteligart’s own advertising or for third-party advertising. When strictly necessary to provide a function or service requested by the client, certain technology providers may process information on Inteligart’s behalf, with the client’s authorization and subject to confidentiality, security and data protection obligations.
  • Artificial intelligence: data obtained from Google is not used to develop, train or improve generalized or foundation artificial intelligence or machine-learning models. If an artificial intelligence tool processes information obtained from Google for a task requested by the client, that processing is limited to providing the requested task or service and is performed under conditions that prevent the data from being used to train generalized models.
  • Deletion: clients may request deletion of data or reports retained by Inteligart by emailing contacto@inteligart.com, subject to applicable legal or contractual retention obligations.
  • Revoking access: clients may revoke access at any time through their Google Ads account settings or at https://myaccount.google.com/permissions, or by emailing contacto@inteligart.com.

Inteligart’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements.

4. Purposes

Primary purposes necessary to provide our services include:

  • providing digital marketing, advertising, technology and consulting services;
  • managing and optimizing campaigns;
  • generating reports;
  • responding to requests;
  • managing client relationships;
  • billing;
  • complying with contractual and legal obligations.

Secondary purposes:

We may use contact information to send Inteligart news, commercial information or newsletters.

To opt out of secondary purposes, email contacto@inteligart.com with the subject “Opt out”.

Opting out does not affect contracted services.

5. Transfers and service providers

We do not transfer your personal data to third parties without your consent, except where permitted or required by law.

Service providers acting on Inteligart’s behalf may process information when necessary to provide our services, including hosting, email, storage, analytics and technology providers.

These providers must process information in accordance with our instructions and applicable confidentiality, security and data protection obligations.

Information obtained from Google APIs is also subject to the restrictions described in section 3 of this Privacy Policy.

6. Your rights

You may exercise your rights to access, rectify, cancel or object to the processing of your personal data, revoke your consent or request limitations on the use or disclosure of your information.

You may submit a request by emailing contacto@inteligart.com.

Depending on the request, please include:

  • the data subject’s name;
  • a method for receiving notifications;
  • documents proving the identity of the data subject or, where applicable, their representative;
  • a clear description of the personal data involved;
  • the right you wish to exercise or a clear description of your request;
  • any additional information that may help us locate the relevant data.

We will communicate our determination within a maximum period of 20 days from receipt of the request.

If the request is granted, it will be implemented within the following 15 days, subject to any extensions or exceptions allowed by applicable law.

7. Security

We apply reasonable administrative, technical and physical safeguards to protect personal information against damage, loss, alteration, destruction, unauthorized use or unauthorized access.

Accounts with access to client data use additional security controls, including two-step verification where applicable.

8. Cookies and similar technologies

Our website may use cookies and analytics tools, such as Google Analytics, to understand how the website is used and improve its operation.

These technologies may collect information such as IP address, browser type, device, pages viewed, date and time of access and website interactions.

You can limit or disable cookies through your browser settings.

9. Changes

We may update this Privacy Policy when our practices, services or legal requirements change.

The current version will be published on this page and will indicate its latest update date.

10. Authority

If you believe your personal data protection rights have been violated, you may contact Mexico’s Secretaría Anticorrupción y Buen Gobierno or any authority that is legally competent for personal data protection in Mexico.
